Why do I need a commercial property solicitor?

Instructing solicitors when leasing or buying commercial property makes sound business practice.

What is commercial conveyancing?

Commercial conveyancing is the legal process involved in buying, selling, or leasing business properties. Although the process may resemble residential property conveyancing, there are more steps involved in the process which can be complicated.

What searches and surveys do I need before buying?

When buying, your commercial conveyancing solicitor will ask you to provide some documents to help with the purchase. They will conduct searches on the property and the land it sits on to make sure there is nothing that could affect your purchase. These searches can include title checks, environmental searches, structural surveys, asbestos inspection and Energy Performance Certificate (EPC).

How long does commercial conveyancing take?

Commercial conveyancing typically takes between 6–8 weeks, although complex deals may take longer. Once your solicitor has an understanding of your case, they will be able to give you an accurate timeline.

Do I have to pay stamp duty?

Any transactions where the property or land values exceed £150,000 require payment of Stamp Duty Land Tax (SDLT). The rates for SDLT vary depending on the land/property use as well as if it is freehold or leasehold property. Your commercial property solicitor will be able to inform you of how much your SDLT will be. Complex transactions may require, third party financial advice.
